Terms & Conditions

This document is an electronic record under the Information Technology Act, of 2000, and related rules. As an electronic record, it does not require physical or digital signatures. It is published in compliance with Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, which mandates the publication of rules, regulations, Privacy Policy, and user agreement for access or usage of Jobanya and its services.

Jobanya is a platform connecting job seekers with employers, placement consultants, and agencies in the recruitment market. Jobanya and its affiliates provide access to various services, including the www.jobanya.com website (the "Website"), the Jobanya mobile application (the "App"), and all related products and services (collectively, the "Services"). The Website and App are owned and operated by M/s VinMeen Infotech, a company incorporated under the Indian Companies Act, of 2013.

By using our Services, you agree to these Terms of Use and all applicable laws. These terms govern the relationship between Jobanya and its users, including job seekers, employers, recruiters, and placement agencies.

Services Provided

Jobanya connects you with job seekers, jobs, or employers, allowing you to search, browse, and communicate with relevant parties. Automated matching processes, facilitated by algorithms, may limit the visibility of certain jobs based on qualifications and criteria. We ensure safeguards to protect your rights and allow you to contest automated decisions where possible. Our Services may also include links to third-party services, which are governed by their terms of use.

Registration and Use

To use certain features of the Website and App, you may need to register. We reserve the right to approve or deny registrations at our discretion. Once registered, you are responsible for maintaining the confidentiality of your password. You may also register using Facebook or Gmail accounts, and their respective terms will apply.

To use the Website and App effectively, you may need to provide accurate information, such as your name, contact details, work history, and identification numbers. By registering, you confirm that you are at least 18 years old and legally competent to contract under Indian law.

Permitted Use

You agree not to::

  • Take passwords or personally identifiable information from other users.
  • Breach security measures or access data unauthorized.
  • Interfere with the Website or App's operations.
  • Post misleading, inappropriate, or illegal content.
  • Use the Website or App for unauthorized commercial purposes.
Good Faith Usage

By creating an account, you agree to use Jobanya Services in good faith, solely for their intended purpose as job/employment tools.

Security

While Jobanya strives to protect your content and account, we cannot guarantee complete security. You are responsible for maintaining the confidentiality of your account and must notify us of any unauthorized access.

Data Privacy

Our Privacy Policy governs the collection, use, and disclosure of your personal information. By using our Services, you consent to our Privacy Policy.

User Content

You are responsible for any content you post, submit, or link to through the Services. Jobanya reserves the right to monitor and remove content that violates these Terms of Use.

You grant Jobanya a license to use your content in connection with our Services. Your content may be made public and redistributed through the Internet and other media channels.

Rules for Placement Consultants / Agencies

Placement consultants and agencies must not submit job listings that do not belong to them. Any resume database or information provided through Jobanya must be used solely for providing placement/employment services and not for any illegal or harmful purposes.

Payment Terms - Cancellation & Refund Policy

YOU ARE REQUESTED TO HONOUR YOUR PAYMENT OBLIGATIONS TO THE COMPANY.
1. Payment Terms
  • Advance Payment: Payments for services offered on the Platform shall be on a 100% advance basis. Once subscribed, payments are non-cancellable and non-refundable. Any amount paid shall be considered appropriated.
  • Invoice: The User irrevocably accepts to receive the tax invoice as a soft copy through emails.
2. Refunds
  • Discretion of Company: Refunds, if any, will be at the Company's sole discretion.
  • Accuracy and Timeliness: The Company offers no guarantees regarding the accuracy or timeliness of refunds reaching the Customer's card/bank accounts.
3. Performance Obligation
  • Service Access: The Company’s performance obligation is to provide access to its online portal for the subscription period. Any reference to usage limits is to set the upper limit for consumption and does not create additional performance obligations.
  • Server Uptime: The Company gives no guarantees of server uptime or proper application functioning. Liability is limited to the refund of the amount only. Free services have no liability.
4. Suspension or Termination
  • Non-Compliance: In the event of suspension or termination of services due to non-compliance with these Terms of Use, any payment made to the Company shall be forfeited immediately.
5. Set Off
  • Excess Payments: The Company, at its sole discretion, may set off any excess amount paid by a subscriber/user against any amount(s) payable by the User to the Company under any other agreement or commercial relationship.
6. Tax Deductions
  • TDS Certificate: Users must promptly provide a copy of the TDS certificate to the Company as mandated by law for tax deducted at source. Any loss due to non-availment or disallowance of TDS credit because of the User's lapse shall entitle the Company to seek reimbursement or indemnification.
7. Payment Gateways
  • Third-Party Transactions: Users making payments online are redirected to third-party gateways for completing transactions. These transactions occur on a third-party network and are not controlled by the Company.
  • Responsibility: Users are solely responsible for carrying out transactions involving credit cards/debit cards or other payment instruments. The Company assumes no responsibility or liability for improper use of such information.
8. Disclosure of Information
  • Account Information: The Company shall not be liable for any loss or damage sustained due to any inadvertent or otherwise disclosure of information concerning the User's account or online transactions using credit/debit cards. The Company assumes no liability for any error, omission, or inaccuracy in the information disclosed, whether pursuant to legal process or otherwise.
Refund Policy
Rules for Refund:
  1. All payments for services provided by the Platform are on a 100% advance basis. Once subscribed, payments are non-cancellable and non-refundable. All amounts paid will be considered appropriate.
  2. Refunds, if any, are at the sole discretion of the Company.
  3. Users agree to receive tax invoices via email in soft copy format.
  4. The Company’s obligation is limited to providing access to its online portal during the subscription period. No additional performance obligations exist beyond this.
  5. The Company does not guarantee the accuracy or timeliness of refunds to your card/bank account.
  6. Payments made will be forfeited immediately in the event of service suspension or termination due to non-compliance with these Terms of Use.
  7. The Company may, at its discretion, set off any excess payment against other amounts payable by the User under any other agreement or commercial relationship.
  8. The Company does not guarantee server uptime or the proper functioning of applications. Liability is limited to the refund of the amount only, and no liability is accepted for free services.
  9. Users are responsible for providing TDS certificates as required by law. Any loss due to non-compliance will entitle the Company to seek reimbursement or indemnification.
  10. Payments made through third-party gateways are not controlled by the Company. Users are solely responsible for any online or offline transactions involving credit or debit cards. The Company assumes no liability for the improper use of such information.
  11. The Company is not liable for any loss or damage due to disclosure of information related to online transactions, whether inadvertent or otherwise.
Refund Process:
  1. Upon receiving a refund claim, our team will contact you to validate the response. Post verification, we will notify you of the refund status.
  2. If approved, the refund will be processed to the original method of payment within 5-7 business days.
  3. No refunds will be provided to Placement Agencies, consultancies, or users who have opted for customized plans beyond standard offerings.

Intellectual Property and Licenses
Limited License:
  1. Subject to these Terms of Use, we grant you a limited, non-sublicensable license to access the Website and App, use our Services, and print materials for employment and hiring needs only.
  2. This license does not allow copying, selling, scraping, or framing any part of the Website, App, or Services. We reserve the right to terminate your license without notice and block future access to the Website, App, and Services.
  3. Unauthorized use of the Website, App, or Services terminates the license granted by these Terms of Use.
Ownership of Content:
  1. All content on the Website and App, including logos, designs, databases, and user interfaces, is the sole property of Jobanya or our licensors. No other rights are granted beyond the limited right to access and use the Website and App.
  2. You grant Jobanya a non-exclusive, royalty-free, worldwide, transferable, and sublicensable license to use any materials or trademarks you provide.
  3. You may not copy, modify, or remove any part of the Website, App, or its content, nor use unauthorized search mechanisms.
  4. Any violation of this clause may result in the immediate termination of your access and potential legal action.
Protection of Materials:
  1. All materials on the Website, App, and Services, including branding, logos, text, and graphics, are protected by Indian and international intellectual property laws.
  2. Unauthorized use, including copying or imitation of our Materials, is prohibited without written permission.
  3. Third-party trademarks appearing on the Website or App are the property of their respective owners, and their inclusion does not imply endorsement by Jobanya.

Third-Party Links and Services:

  1. The Website and App may contain links to third-party websites, services, or content. Jobanya is not responsible for the content or practices of these third parties.
  2. Your use of third-party links or services is at your own risk, and Jobanya is not liable for any issues arising from such use.
No Warranties:
  1. The Website, App, Materials, and Services are provided "as is," with no express or implied warranties. All use is at your sole risk.
  2. Jobanya disclaims all warranties, including those of merchantability, fitness for a particular purpose, title, and non-infringement.
  3. Jobanya is not responsible for user content, third-party content, or the accuracy of jobseeker resumes.
Limitation of Liability:
  1. Jobanya is not liable for any indirect, special, incidental, or consequential damages arising from the use of the Website, App, or Services.
  2. The aggregate liability of Jobanya shall not exceed INR 100. Jobanya is not liable for any loss of profits, business, data, goodwill, or other damages.
General Terms:
  1. Jobanya reserves the right to terminate your access to the Website, App, and Services at any time.
  2. Jobanya is not liable for any acts beyond our control or acts of God.
  3. Complaints regarding the Website, App, or Services should be directed tosupport@jobanya.com.
  4. Jobanya reserves the right to modify or discontinue the Website, App, or Services at any time.
Governing Law and Dispute Resolution:
  1. These Terms of Use are governed by Indian law, with jurisdiction in Tamilnadu, India.
  2. Any disputes that cannot be resolved amicably will be settled by arbitration under the Arbitration and Conciliation Act, 1996.
